The
Town Ordinance does not
define ‘public’ and
‘private’ pool, although
they are defined in the
Building Code and by the
Health Department, as
well as NCAC 130A-280.
Private pools are Single
Family only and public
pools are Multifamily
(i.e., duplexes,
townhouses, condos,
etc).
Conditional use permits
have not been required
in the past. However, in
accordance with
Sec. 128 TABLE 1.
PERMITTED AND
CONDITIONAL USES,
pools for multifamily
(duplexes, townhouses,
condos, etc) in all
residential zoned
properties (i.e., MHR
R-5 R-8 R-10 R-15 R-20
and R-A) require a
conditional use permit.
Effective immediately,
conditional use permits
will be required for all
public pools.
