CALL TO ORDER: APPOINT OFFICERS AND
DUTIES: APPROVAL OF AGENDA: Mr. Miller motioned to open the Public Hearing on Variance Request- Mr. Charles K. Harris section 7-151 substandard lots. Mrs. Rowland seconded the motion, motion passed unanimously. Public Hearing on Variance Request- Mr. Charles K. Harris Section 7-151 Substandard Lots Mr. Harris the property owner of 2802 Island Dr. Lot 13 Ocean City came forward to present his case. Mr. Harris presented a survey from Charles Riggs showing 3500 sq ft. lot. The adjoining lots have homes on both sides and they are similar lots in size. According to the CAMA Officers Mrs. McLaughlin and Mr. Moore the adjoining lots are rebuildable. Mr. Harris stated that he just wanted to get his lot buildable. Mr. Harris has a survey by Mr. Riggs, a 3 bedroom septic permit from the county and a site plan. The septic system approved by the county is a Peat Bio filtration septic system. Mr. Harris stated depending on how he builds his decks he can build a nice 1500-1600 sq ft. two story home on this lot. Mr. Smith asked how long Mr. Harris has had this lot. Mr. Harris stated that he has had this lot for a year and a half. Mr. Swantek asked where the septic was going to be located. Mr. Harris stated it would be in the back of the property towards the ocean side. Mr. Miller stated that the county approved the septic but what does the Town of North Topsail Beach say. Mr. Harris stated that the Town really doesn’t have any thing to do with septic, it’s the county. Mr. Convy asked how close the septic system was to the house behind him. Mr. Harris stated that it was 5 ft. from the house and 5 ft. from the property line. Mr. Miller asked Mr. Harris why he is not buildable. Mr. Harris stated that there is an 80/20 rule which means you are suppose to have around 4000 sq. ft. and they must have done that when they incorporated the town. Mr. Convy asked if there were any questions from the public. Mr. Eves stated that he had to put a peat system in for his house and Onslow County is very strict on what you have to do. Mr. Convy stated that the only thing we have been requested to do is a variance on the lot size not the house or the set backs. Mrs. Rowland suggested we have the staff come back with the septic information and what size of a house he would be able to build there to make it conforming. Mr. Miller motioned to close the Public Hearing on Variance Request for Mr. Charles Harris Section 7-151 Substandard Lots. Ms. Rose-Justice seconded the motion, motion passed unanimously. Discussion and Decision on Variance Request: Mrs. Rowland motioned to table the variance until the next meeting. Ms. Baldwin seconded the motion. Motion passed unanimously. Public Hearing on Variance Request –Mr. James Eves Section 7-142 Other Yard Modifications Mr. Eves, the property owner of 7513 9th Ave. came forward and stated the Zoning Officer at the time told me all along through the whole building process that I was in compliance. Mr. Casey the Building Inspector at the time signed off on the CO. Mrs. McLaughlin had left the town by this time. Mr. Moore was hired and told me I was 3 ft. too far into the set back with my front steps. Mr. Eves stated that if he could find a builder with a decent set of plans for his steps he would change them if he could. Mr. Smith asked the Board Members if we could have a special second meeting to take care of these Variances. Mr. Convy stated that we will address this as soon as possible. Ms. Rose-Justice motioned to recess. Ms. Baldwin seconded the motion, motion passed unanimously.
