Planning Board Minutes

PRESENT:  MIKE YAWN- CHAIRMAN, SUE TUMAN, DON MARTIN, GARY ROWLAND, PAUL DORAZIO- VICE CHAIRMAN, GERALD RIGGLEMAN, GUNNAR MATTHEWS, DEBORAH HILL- ZONING ADMINISTRATOR

I.                   CALL TO ORDER:  Mr. Yawn called the meeting to order at 6:30 p.m. in the North Topsail Beach meeting room.

II.                APPROVAL OF AGENDA:

Mr. Martin made a motion to approve the agenda.  Mr. Matthews seconded the motion, motion passed unanimously.

III.             APPROVAL OF THE MINUTES:

Mr. Rowland made a motion to approve the minutes as amended.  Mr. Martin seconded the motion, motion passed unanimously. 

IV.             OLD BUSINESS:

A.    Boardwalk Villas: Site Plan Review

Ms. Hill stated that included in the Board package is a Staff Report for the Boardwalk Villas.  She stated that in there are conflicts in  the Town’s Ordinance; when she read through the Ordinance she noticed that 7-219.1 reads as follow “site development plan approval” implies approval is to be granted by the Planning Board.  She also stated that in 7-218 of the Ordinance it stipulates requirement of approval from the Board of Aldermen.

Staff recommends that the Planning Board review the Boardwalk Villas site plan and forwards its recommendation to the Board of Aldermen for their review and approval at their next Board of Aldermen meeting June 7, 2007. 

Ms. Hill stated that the Conditional Use Application and sketch plan for the Planned Residential Development were approved by the Board of Aldermen on December 7, 2006.  The 5.59 acres is located 4.4 miles northeast of the SR 210 and 1568 intersection on the New River Inlet Road.  The property is currently vacant and zoned R-5.  The adjoining properties are zoned R-5 and parcels across the street are zoned R-10.  Lots will be served by existing and proposed extensions of ONWASA’s water lines and North Topsail Utilities sewer system.

Ms. Hill stated that she has a check list and it is basically an outline of Section 7-219 in the Ordinance.  She stated that check marks in the box indicate that the condition has been met.   

After much discussion the Planning Board suggested making a condition of the recommendation that the Board of Aldermen consider the following: 

  • Put revision dates/reasons on plat documents
  • If sewer permits are not possible, and they need to install a temporary onsite septic system, a new site plan is required, with review from Planning Board and sign off from Board of Aldermen
  • Fire dept. needs to review and approve site plan
  • Include the exact total number of parking spaces
  • Public beach accesses-Board of Aldermen to consider Handicapped Access or Viewpoint
  • Applicants Attorney to review section in Covenants on splitting lots; violates Town Ordinances to split them

 Mr. Rowland made a motion to recommend to the Board of Aldermen the ESP proposed PRD with the conditions stated above.   Mr. Dorazio seconded the motion, the motion passed 5 to 2 with Mr. Yawn and Mr. Martin voting nay.

V.                NEW BUSINESS

A.    Roger’s Bay Property Owners Association letter dated May 8, 2007: Request to amend NTB Town Ordinance Section 7-222

Mr. Yawn stated that Rogers Bay Property Owners Association would like to amend the Town’s Ordinance Section 7-222; Operating Standards for existing travel trailer parks and new parks, following park plan approval, can have larger storage buildings.

Mr. Yawn explained the process, because this is a change to the Town’s Ordinances.  In order to change the Town’s Ordinance there has to be a Public Hearing with the Planning Board and it has to be advertised.  He stated that the Planning Board can add this to their next meeting on June 14, 2007 and once the Planning Board makes a recommendation to the Board of Aldermen, and then they will have to have a Public Hearing.  He stated that the Board of Aldermen makes the final decision.

Mr. Dorazio stated this item was brought up to the Planning Board several years ago and it was turned down; he stated that obviously they need more storage.  Mr. Dorazio had asked that the representatives from Rogers Bay provide information on lot sizes and numbers of each size.  Representatives from Rogers Bay agreed to do so when the Planning Board has their Public Hearing.

Mr. Yawn stated that one issue he sees is these structures would need to meet all of the Town’s flood requirements.

Mr. Riggleman made a motion to have a Public Hearing at the Planning Boards next meeting June 14, 2007 to consider amending the Town’s Ordinance Section 7-222.  Mr. Martin seconded the motion, motion passed unanimously.

VI.             PLANNING BOARD DISCUSSION OF PROPOSED TOPICS FOR NEXT MONTH’S AGENDA

Mr. Matthews stated that the Planning Board needs to have two alternates.  Mr. Yawn stated that the Board of Aldermen had a couple of candidates and did not vote on them, he stated that he will bring it up at the next Board of Aldermen’s meeting in June.

Mr. Martin asked how the changes in the Ordinances are going with Ms.Booker.  Ms. Hill stated that she and Mr. Smith will be meeting with Ms. Booker soon.  Mr. Yawn stated that he would like a consolidated draft from Ms. Booker of the entire Zoning Ordinance so the Planning Board can start looking at the changes and send the updates.

    VI.      PUBLIC COMMENT:

Mr. Peters asked about the Tree Ordinance.  Mr. Yawn stated that several months ago the Planning Board drafted a Tree Ordinance, it went to the Board of Aldermen and the Board of Aldermen had issues with it on enforcement and species.  He stated that the Planning Board still has a mission to revise the draft and get an updated draft to the Board of Aldermen for them to look at.

Mrs. Tuman asked if the Planning Board should put this on next month’s agenda.  Mr. Yawn stated that the Planning Board will look at the Tree Ordinance next month along the Subdivision Ordinance. 

VII.          ADJOURNMENT:
